In using this website you are deemed to have read, understood, and agreed to the following Terms & Conditions, which govern your access to and use of the site, products, promotions, and services offered by Enrico Puglisi Flies Ltd. (“We”, “Us”, “Our”, the “Company”).

Promotional Discount
The 10% discount offered in celebration of the launch of our new fly fishing website is subject to the following limitations:
- Cannot be combined with other offers or discounts.
- Not applicable to EP Program participants (Dealers, Captains & Guides, Commercial Fly Tyers, or other professional accounts).
- Offer ends September 21, 2025.

Definitions
“Client”, “You”, “Your” refers to the person using or purchasing via this website.
“EP Program participants” means those accounts designated as part of our commercial or professional accounts, including but not limited to Dealers, Captains & Guides, Commercial Fly Tyers.

Shipping & Delivery
- We offer free standard shipping via USPS on orders over $50 shipped within the Continental United States. Those in Hawaii, Alaska, and all other areas worldwide are subject to actual shipping charges. Free shipping does not apply to EP Program participants.
- Express shipping options (UPS, FedEx) are available; contact us for quotes.
- Orders placed before 3pm EST generally ship the same day but may take up to 72 hours to process.
- International orders are placed without shipping cost at checkout which will be updated to actual shipping price. We will not mark international orders as “gift” or undervalue them for customs. The customer is responsible for all customs, duties, taxes, and fees in their jurisdiction.

Exchanges & Returns; Restocking Fee
- Contact us within 72 hours of receiving your order to initiate exchanges or returns.
- All returned or exchanged items must be in the same condition as received: new, unused, in the original packaging, with tags and labels still attached.
- A 20% restocking fee applies to all non-defective returns. Items returned due to defects (as confirmed by us) are exempt from restocking fees.
- Items that show signs of use or are no longer in new condition are not eligible for return.

Defective Products
- If you receive a product you believe to be defective, contact us with details of the defect. We will examine it upon return and decide whether to issue a refund or replacement.
- If a defect is confirmed, we cover return shipping for the defective product. Otherwise, return/exchange shipping is your responsibility.

Warranty Disclaimer
To the fullest extent permitted by law:
- Products are provided “as is” without warranties of any kind, except where prohibited by law.
- We expressly disclaim implied warranties of merchantability and fitness for a particular purpose, except to the extent such disclaimers are not permitted under applicable state or federal law.
- Some jurisdictions, including New York, may provide consumers with non-waivable rights. Nothing in these Terms is intended to limit those statutory rights.

Limitation of Liability
- We are not liable for indirect, incidental, punitive, or consequential damages arising from use of the site, products, or from any breach of these terms.
- Our maximum liability for any claim is limited to the purchase price you paid for the relevant product(s).
- Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or personal injury caused by our negligence.

Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the State of New York. You submit to the exclusive jurisdiction of the courts located in New York for any legal proceedings.

- We reserve the right to modify these Terms at any time; changes take effect when posted on the website. Continued use of the site constitutes your acceptance of those changes.
